Terms of Service – CantyDigital Creative PTY LTD

1. Introduction
These Terms of Service (“Terms”) govern the provision of digital marketing services by CantyDigital Creative PTY LTD (“Company,” “we,” “us,” or “our”) to you (“Client,” “you,” or “your”). By engaging our services, you agree to these Terms.

2. Services Provided
We provide subscription-based digital marketing services, including but not limited to SEO, PPC management, content marketing, social media marketing, and web development. The specific services provided will be outlined in you strategy or proposal.

3. Payment & Fees
All services are billed on a subscription basis. Payment is required in advance, either monthly or as per the agreed billing cycle. Late payments may result in the suspension or termination of services. Any additional work outside of the agreed scope will be quoted separately and must be approved before commencement.

4. Cancellation & Termination
We require a 30-day written notice to cancel any services. Notice must be sent to admin@cantydigital.com and/or matt@cantydigital.com. This notice period allows us to properly conclude your campaign and transition any assets if applicable. If you cancel before the 30-day period ends, you will be responsible for the final billing cycle. CantyDigital Creative PTY LTD reserves the right to terminate services at any time due to non-payment, breach of these Terms, or any other reason deemed necessary.

5. Client Responsibilities
The Client agrees to provide all necessary access, materials, and approvals required to perform the services effectively. Failure to do so may impact the effectiveness of the campaign, and CantyDigital Creative PTY LTD will not be held liable for such delays.

6. Performance & Results
While we employ industry best practices to achieve optimal results, we do not guarantee specific outcomes such as first-page rankings, conversion increases, or revenue growth. Digital marketing results depend on various external factors, including industry competition, search engine algorithms, and consumer behavior.

7. Intellectual Property
All materials created by CantyDigital Creative PTY LTD, including but not limited to marketing content, ad creatives, and website assets, remain the property of the Company until full payment is received. Upon payment, ownership may be transferred based on prior agreement.

8. Confidentiality
Both parties agree to maintain the confidentiality of proprietary or sensitive information shared during the engagement.

9. Liability & Indemnification
CantyDigital Creative PTY LTD shall not be held liable for indirect, incidental, or consequential damages arising from the use of our services. The Client agrees to indemnify and hold us harmless against any claims, losses, or damages resulting from the Client’s use of our services.

10. Amendments
We reserve the right to update or modify these Terms at any time. Clients will be notified of any significant changes. Continued use of our services after an update constitutes acceptance of the revised Terms.

11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes shall be resolved in the courts of New South Wales.
